Not Just a Farm Case

Johan Sandberg, representing the well-known "cow farmer" whose 69 cows were taken in December 2012/2013 on a farm in Södermanland, achieved a complete victory in the Supreme Court. On January 29, 2020, the Supreme Court ruled in case T 481-19 that Länsförsäkringar Södermanland was not entitled to terminate the farmer's insurance prematurely on the grounds of providing incorrect information. The court found that the company acted negligently in making the terminations and is therefore liable for damages to the farmer.

The ruling is of significant precedent value as there is a lack of case law and clarifying statements in literature regarding the conditions under which an insurance company may terminate a policy prematurely and the consequences if such a termination is done incorrectly.

Next, the damage calculation will take place to establish the farmer's claim for compensation against the insurance company.
